Iraq and the Laws of War
Francis A. Boyle
On 19 March 2003 President Bush Jr. commenced his criminal war against Iraq by ordering a so-called decapitation strike against the President of Iraq in violation of a 48-hour ultimatum he had given publicly to the Iraqi President and his sons to leave the country. This duplicitous behavior violated the customary international laws of war set forth in the 1907 Hague Convention on the Opening of Hostilities to which the United States is still a contracting party, as evide! nced by paragraphs 20, 21, 22, and 23 of U.S. Army Field Manual 27-10 (1956). Furthermore, President Bush Jr.’s attempt to assassinate the President of Iraq was an international crime in its own right. Of course the Bush Jr. administration’s war of aggression against Iraq constituted a Crime against Peace as defined by the Nuremberg Charter (1945), the Nuremberg Judgment (1946), and the Nuremberg Principles (1950) as well as by paragraph 498 of U.S. Army Field Manual 27-10 (1956)…

Religion and Violence
U.S. encourages “religious fundamentalism” to counter nationalist & socialist movements
Ghali Hassan, GlobalResearch.ca
…In Iraq, the U.S. is cultivating all kinds of religious fundamentalists and fanatics at the expense of progressive and nationalist movements. Nationalism and pan-Arabism is imperialism real enemy, not religious fundamentalism. It is now clear that the U.S. supports and encourages sectarian forces and territorial disintegration, as spelled out in the U.! S.-crafted illegitimate constitution; the trap for unending colonial occupation. The truth is that the U.S. and its Western allies are not concern with democracy and the rules of law; they act collectively to enhance and protect their own imperial and Zionist interests with disregard to human rights and democracy…

DOEBBLER ON SADDAM HUSSEIN‚S TRIAL: “THE SITUATION IS RIDICULOUS.”
Malcom Lagauche
With Saddam Hussein‚s trial quickly approaching, much speculation has been made of the event. Most agree that it will be a mockery and the court has already made up its mind to execute the Iraqi President. Recently, I had the privilege of interviewing international human rights lawyer Curtis Doebbler for the second time. He is part of the legal team working for the defense. However, neither he nor any member of the defense team has! been able to meet with the President. The following are Dr. Doebbler‚s statements about the fairness of the upcoming trial…

US Forces Starving Iraqi Civilians: UN
IslamOnline.net
The UN special rapporteur on the right to food has accused the US-led occupation forces of starving Iraqis civilians in besieged cities and depriving them of water to force them. “A drama is taking place in total silence in Iraq, where the coalition’s occupying forces are using hunger and deprivation of water as a weapon of war against the civilian population,” Jean Ziegler told a press conference Friday, October 14, reported Reuters…

Interview with Salah Almukhtar
Stefano Chiarini, il manifesto
The occupation of Iraq, by American colonialism, is a crime against humanity, as well as violation of the international law,and the charter of the United Nations. The occupation has fundamental objectives, the first objective is to destroy it the independence and territorial integrity of Iraq, by destroying the national shield of Iraq, which is Baath party, then the second objective is transforming Iraq into a colony, fully controlled by the United S! tates, to be used to export the so called (American Empire), through the so called (American democracy). The third objective is the exploitation of the Iraqi oil for the purpose of solving the internal 0il crisis of the United States, and to use the oil as a blackmail tool against all other nations, because oil, according to new American geopolitical plan, is a powerful tool of blackmailing all other nations specially the union of Europe, China, India, and other nations…

Iraqis to vote on neo-colonial constitution
James Cogan, WSWS
The referendum today in Iraq on the draft constitution is a cynical and, for the Iraqi people, humiliating event. Far from an exercise in self-determination, it is the next stage in a US-crafted, but increasingly crisis-ridden process aimed at turning Iraq into an American client state in the Middle East. Bush, Cheney, Rumsfeld and others among the clique responsible for the illegal 2003 invasion will use today‚s vote to justify their crimes with the c! laim that “democracy‰ is being realised in Iraq…

Best bet: Dividing Iraq
Aljazeera.com
…Dividing Iraq has been an old Israeli dream. In 1982, Oded Yinon, an official from the Israeli Foreign Affairs office, wrote: “To dissolve Iraq is even more important for us than dissolving Syria. In the short term, it’s Iraqi power that constitutes the greatest threat to Israel. The Iran-Iraq war tore Iraq apart and provoked its downfall. All manner of inter-Arab conflict help us and accelerate our goal of breaking up Iraq into small, diverse pieces.” Gelb‚s plan is disso! lving Iraq while transforming the north (Kurdish majority) and the south (Shiite majority) into “self-governing regions, with boundaries drawn as closely as possible along ethnic lines”…

Civilwarland in Bad Decline
Xymphora
From Iraqi Resistance Report (scroll down a bit): “A number of Iraqis apprehended two Americans disguised in Arab dress as they tried to blow up a booby-trapped car in the middle of a residential area in western Baghdad on Tuesday. Residents of western Baghdad’s al-Ghazaliyah district told Quds Press that the people had apprehended the Americans as they left their Caprice car near a residential neighborhood in al-Ghazaliyah on Tuesday afternoon (11 October 2005). Local people ! found they looked suspicious so they detained the men before they could get away. That was when they discovered that they were Americans and called the Iraqi puppet police…

The Referendum…
Riverbend, Baghdad burning
…Iraqis are going to be voting according to religious clerics and, in some areas, tribal sheikhs. They aren‚t going to be voting according to their convictions or their understanding of what is supposed to be a document that will set the stage for Iraqi laws and regulations. Juan Cole wrote about an example of this with Muqtada Al-Sadr‚s followers: The young Shiite nationalist, Muqtada al-Sadr, advised his followers to consult the ruling of Ayatollah Kadhim al-Hae! ri (resident in Qom, Iran) concerning how to deal with the constitution. He said that this was an issue that required independent juridical reasoning (ijtihad). That‚s all we need- it‚s not enough that Zalmay Khalilzad is gushing over the constitution- all we need now is another cleric (stationed in Iran this time) to influence the masses…

Iraqi Resistance Report for events of Friday, 14 October 2005
Translated and/or compiled by Muhammad Abu Nasr, member, editorial board, the Free Arab Voice. ( www.freearabvoice.org )
…In an effort to prevent any public expression of dissent over the “Constitution‰ that the United States is seeking to impose on occupied Iraq through a referendum slated for Saturday, US forces surrounded every Sunni mosque in Baghdad on Friday at the time of the weekly congregational prayer services at midday. The Mafakr! at al-Islam correspondent in Baghdad reported that between 10 and 15 US soldiers had taken up positions around every Sunni mosque. They did nothing to prevent worshippers from entering the buildings, but were ready to storm in and arrest the Imam in the event he said anything in his sermon of which they disapproved…

Iraqi Politics Main Dish on Iftar Tables
IslamOnline.net
…The document that is supposed to unite the country is rejected by many Sunni Arabs, who fear it will deepen sectarian divisions with Shiites. “At university, so many of the students are breaking into different groups, this one Sunni, this one Shiite, it’s really not good. They are not focusing on the things they should be thinking about — their studies,” says Suad. She told Reuters that she is also disillusioned, as is her husband, by the constant talk ! of Sunni and Shiite that spreads threateningly around the country, something they say never used to happen…

Man of Peace: Harold Pinter, Winner of the Nobel Prize for Literature
John Pilger, t r u t h o u t
…What struck me about Harold’s involvement was his understanding of this truth, which is generally a taboo in the United States and Britain, and the eloquent ‘to hell with that’ response in everything he said and wrote. Almost single-handedly, it seemed, he restored ‘imperialism’ to the political lexicon. Remember that no commentator used this word any more; to utter it in a public place was like shouting ‘fuck’ i! n a covent’. Now you can shout it everywhere and people will nod their agreement; the invasion in Iraq put paid to doubts, and Harold Pinter was one of the first to alert us. He described, correctly, the crushing of Nicaragua, the blockage against Cuba, the wholesale killing of Iraqi and Yugoslav civilians as imperialist atrocities…

How to constitute a civil war
Pepe Escobar
Iraqis desperately need security, electricity, water, food rations, health care, education, jobs. Instead they get a referendum on a constitution few of Iraq’s theoretical 15.7 million voters have debated and fewer still have even seen. Why? Because the occupying power said so. So forget about the real priorities needed to make life liveable. No constitution will be able to rule over a battlefield…

Taking Iraq Apart
Salim Lone, The Guardian
…After the 2003 war, the Americans reorganized Iraqi political life along sectarian lines, with the July 2003 Iraq governing council’s membership to be filled by 12 Shias, five Kurds, five Sunnis, one Turkoman, one Assyrian and one Chaldean. At the same time, the US worked systematically to eliminate all Saddamist (which meant Sunni) influence from national life. The majority Shias were picked to hold the reins of power, and their fealty to US goals in Iraq was to be f! urther assured by the prospect of a constitution that would offer them an oil-rich autonomy similar to the Kurds…

Iraq Referendum on Constitution: Illegal Legislation
Patriotic, National & Islamic Front, Globalresearch.ca
…The constitutional referendum game is part of plans prepared long ago by the occupiers to legalise the invasion and occupation of Iraq and its consequences. The occupation, according to all laws & principles, is considered as a crime committed against a sovereign state, a crime of illegal war of aggression that destroyed our country and in breach & violation of all sound principals of international law. ! According to resolution 1514 of the General Assembly of the United Nations, issued on the 14th of December 1960, any occupier of a soil of any state is a violation of the principals of the UN charter. Also, according to article 42 of the additional protocol of the Hague convention of 1907, any soil of a state is considered occupied, when it is under the de facto authority of the enemy army, as it is now in Iraq & that resistance of such an occupation is a legal right for the people of the occupied state…

Get Ready for G W Bush‚s Next Big Rape Job
Sam Hamod
It was not enough that Bush took our young men and women to war in Iraq, killing thousands of Americans and hundreds of thousands of Iraqis. He also helped cut the funding for the wetlands and levees that protected New Orleans, southern Mississippi and Alabama˜thus, Katrina was the worst disaster in American history. Now Bush wants to rape the poor and middle class further, with his new tax plans that have been overseen by Connie Mack, a non-intellect, but a! bootlicker of the lowest sort.

Plight of Palestinian refugees increased since occupation of Iraq
Arabmonitor
…UNHCR estimates that some 23,000 Palestinians, most of them refugees from the 1948 war, are presently still living in Iraq. Since the US-led invasion of Iraq, the Palestinians have lost all legal protections and have been thrown out of their working places in the public sector. Those whose documents expire, are required to line up every month to apply for monthly residential permits, thus being pushed into a state of outcasts in the ! country most of them have been born into and lived within for all their lives…
